Terms of Service

Welcome to CurveRank. Please read these Terms of Service ("Terms") carefully before using the CurveRank app (the "App") operated by David Stötzel ("CurveRank," "I," "me," or "my").

By accessing or using CurveRank, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of Service

CurveRank is a driving telemetry and social ranking app. The current build may include:

• GPS-based trip tracking
• speed, distance, duration, and trip-performance metrics
• trip history and trip-detail views
• driving statistics, rankings, and leaderboards
• friends, communities, and invite flows
• profile and garage features
• trip recap and share-card export
• in-app support and reporting tools
• subscription-based premium features through CurveRank Pro

CurveRank is currently operated by David Stötzel as an independent developer.

2. Age Requirement

You must be at least 18 years old to use CurveRank. By using the App, you confirm that you meet this requirement.

3. Data Collection and Use

By using CurveRank, you grant permission for the App to:

• collect and analyze trip and driving-related data
• process location data, trip timing, speed, distance, and performance metrics
• generate rankings, analytics, summaries, and insights based on your usage
• store profile data, trip history, and related app data for service operation
• process subscriptions and restore premium access
• operate friends, communities, leaderboard, support, and moderation features

You represent and warrant that:

• you own or have legal authority to use the vehicle from which data is collected
• you have the right to provide the data and content you upload or share
• the information you provide is accurate and not misleading

4. Accounts and Profile Data

The current build uses anonymous backend account creation rather than a traditional email/password login.

You are responsible for:

• maintaining control of your device
• keeping your device secure
• keeping your profile and uploaded content lawful and accurate

You may not impersonate another person or create misleading profile information.

5. Use of Analytics, Rankings, and Reports

The analytics, rankings, reports, and performance metrics shown in CurveRank are provided for informational and entertainment purposes only.

While I aim to make the App useful, I do not guarantee that any metric, ranking, or analysis is complete, accurate, or suitable for any specific purpose.

Leaderboards, rankings, and performance displays are not challenges, competitions, goals, or endorsements of any driving behavior.

6. Lawful and Safe Use Policy

6.1 Intended Use

CurveRank is intended solely for lawful, responsible, and safe use.

By using the App, you agree to comply with all applicable traffic laws, vehicle laws, regulations, and safety requirements in your jurisdiction at all times.

6.2 Prohibited Activities

The App does not encourage, promote, endorse, or condone:

• speeding
• reckless or dangerous driving
• racing or competitive driving on public roads
• violations of traffic laws
• testing personal or vehicle limits on public roads
• using the App in a way that distracts you while driving

Any such use is strictly prohibited and is a violation of these Terms.

6.3 Performance Metrics Disclaimer

The App may display metrics such as:

• top speed
• average speed
• cornering or braking-related stats
• trip distance or duration
• launch or acceleration benchmarks
• rankings and leaderboard placements

These features are provided for informational and entertainment purposes only.

They are not instructions, challenges, or incentives to drive faster, drive harder, or take risks.

6.4 Safe Operation

You agree that:

• you will not interact with the App in an unsafe way while operating a vehicle
• the App does not replace safe driving judgment
• the App does not replace traffic-law compliance
• you alone are responsible for how you operate your vehicle

7. Assumption of Risk

You acknowledge and agree that driving a vehicle inherently involves risk, including property damage, injury, serious bodily harm, and death.

By using the App, you:

• voluntarily assume all risks associated with driving
• accept full responsibility for your own driving behavior and decisions
• agree that you alone control your vehicle at all times

CurveRank does not control, direct, or influence how you drive.

8. Friends, Communities, Rankings, and User Visibility

CurveRank includes social features. By using those features, you understand that certain information may be visible to other users, depending on the feature and your settings.

This may include:

• your username
• your profile photo
• your vehicle details
• your ranking position and leaderboard metrics
• your country, region, or continent labels
• your community participation
• certain friend-only profile information

Ghost Mode may reduce visibility in leaderboard contexts, but it does not guarantee complete invisibility across every feature or every previously shared item.

9. Photos, Sharing, and User Content

You may upload photos and create or export user-generated content through the App.

You are responsible for ensuring that your content:

• belongs to you or you have permission to use it
• does not violate laws or third-party rights
• is not abusive, misleading, defamatory, infringing, or otherwise unlawful

Important current-build note:

• uploaded profile and vehicle images may be stored using public object URLs used by the App
• if you share content through iOS share features, that content may be received and processed by third-party apps or services you choose

Once content is shared outside CurveRank, I may not be able to control or delete copies held by third parties.

10. Subscriptions and Payments

CurveRank may offer subscription plans for premium features through CurveRank Pro.

By subscribing, you agree that:

• subscription pricing and billing terms are shown in the Apple purchase flow
• subscriptions may renew automatically unless canceled through Apple
• Apple manages billing, renewals, and subscription cancellation
• deleting your CurveRank account does not automatically cancel your Apple subscription

Except where required by law or Apple's own policies, payments are generally non-refundable.

If you want to manage or cancel a subscription, you must do so through your Apple subscription settings.

11. Privacy

Your use of CurveRank is also governed by the CurveRank Privacy Policy. Please review the Privacy Policy to understand how your information, including location and driving data, is collected, used, stored, and shared.

12. Prohibited Uses

You agree not to:

• use CurveRank for any unlawful purpose
• use the App in an unsafe or distracting manner while driving
• use the App to race, compete, or test vehicle limits on public roads
• manipulate, falsify, or spoof driving or trip data
• use the App to track others without proper authority or consent
• harass, abuse, threaten, or impersonate other users
• submit false or malicious support requests or driver reports
• reverse engineer, interfere with, or misuse the App or its backend systems
• share access in a way that violates the intended use of the service

CurveRank may suspend or terminate access for violations of these Terms.

13. Data Accuracy and Service Limitations

The App is provided "as is" and "as available."

CurveRank relies on device sensors, GPS, platform services, network connectivity, backend systems, and third-party subscription infrastructure. Because of that, I do not guarantee:

• accuracy of location, speed, or trip data
• completeness or reliability of analytics or rankings
• uninterrupted service availability
• fitness for any particular purpose

You are responsible for how you use any analytics or reports generated by the App.

14. Intellectual Property

All content, features, functionality, design, software, branding, algorithms, and technology in CurveRank are owned by me or my licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, sell, or exploit the App or its content except as permitted by law or with my written permission.

15. Limitation of Liability

To the maximum extent permitted by law, CurveRank is provided without warranties of any kind.

To the maximum extent permitted by law, David Stötzel and any affiliates, contractors, licensors, and service providers will not be liable for:

• accidents or collisions
• injuries or fatalities
• vehicle damage
• traffic violations, citations, fines, or penalties
• legal consequences arising from your driving
• losses caused by misuse of the App
• losses caused by inaccurate metrics, analytics, rankings, or reports
• indirect, incidental, consequential, special, exemplary, or punitive damages

You are solely responsible for your driving behavior, your compliance with law, and your use of any information shown in the App.

16. Termination and Account Deletion

I may suspend, limit, or terminate access to CurveRank if I believe you violated these Terms, created risk for other users, misused the service, or if suspension is necessary for legal, safety, or operational reasons.

The current build includes an in-app account deletion flow. If you delete your account:

• local app data may be removed from your device
• backend profile and related records may be deleted according to the current system design
• uploaded media may remain in technical backups for a limited period

Deleting your account does not automatically cancel an Apple subscription.

17. Changes to These Terms

I may update these Terms from time to time. The latest version will be reflected by the "Last updated" date above. By continuing to use the App after changes take effect, you agree to the updated Terms.
